D64-A/B     ARMY LIVERY DBS 60040 £24.99/£11.99/£9.99/(*)

German company DB Schenker took over the English Welsh & Scottish Railways (EWS) operation from its Canadian founders in 2007. The second Class 60 to receive the DB Schenker branding, 60040 was named "The Territorial Army Centenary" at the NRM on June 14th 2008 by HRH the Duke of York. The main livery colour being the standard EWS maroon, with an advert panel for the Regular & Territorial Army featuring a fluttering union flag with shaded ripples. Until repainted in plain red during June 2012, she ran regularly in revenue earning service:

Here we present all the details that you will need to recreate the 60040 engine in 7mm O-gauge, OO-scale 4mm, or 2mm N-gauge forms, sets of three of everything (one spare):
  • Mirror chrome silver nameplates as filmless no carrier decals,
  • The various white lettering for the engine numbers, logos and advert panels,
  • Also in white, data panels and numerous underframe instruction panels,
  • Nose end numbers in black, with yellow lifting point markings,
  • The flag has the correct true-blue and subtle ripple shadings.

The Decals Scanned.

The first named engine, another Class 60, is the subject of our D15-* decals: 60074 "Teenage Spirit". The third named, 59206 "John F. Yeoman Rail Pioneer" features in our D65-* packs along with decals for the initially unnamed DBS Class 66 engine. Fourth to be named by DBS, a Class 37 engine "St Blazey T&RS Depot" 37670, is the subject of our D74-* packs. Fifth in traffic, 67018 "Keith Heller" appears in our D76-* packs. The name "Derek Holmes Railway Operator" was added to 66152 while in traffic, making it the sixth named engine.

As usual we wrote to the modern branding owners for permission to produce these decals. Our general approach is always that we will not procede if any fees are demanded. We believe modelling has no connection with unrelated commercial interests, and that companies should be pleased to have effectively free advertising. In any case, license fees make decal productions uneconomic.

No reply from DB Schenker, but we were advised by Wider Markets IPT, acting for the MoD's Directorate of Intellectual Property Rights, that any license to re-use the Army advert design would cost at least £250 with 6-20% of merchandising royalties. Apparently no other approaches had been made up to mid July 2008, despite announcements and some other products appearing for sale. We informed both Fox Transfers and Hornby of the discussions and grossly disproportionate costs proposed. Hornby went on to come to a more acceptable arrangement for a OO model to be released in 2009 and we supplied art work for them to use. Fox decided to change their plans:

However, the Army advert is made up from standard font lettering with our nation's flag design, obviously not individually items of intellectual property of the MoD! We decided to go ahead and produce decals made in a way to circumvent any possible claim and stealth taxes over use of the phrase "Army be the best" (trademark? - does the MoD trade ?! - or copyright?). The text rearranged, requires the modeller to simply put the generic components together when applying the decals. The MoD's representatives were informed and invited to challenge our approach, which they did not.

To use our decals you will need to paint a donor model as follows:
  • EWS maroon sides and roof,
  • Orange cantrail as usual,
  • Yellow nose ends under the cab windows,
  • A gloss base varnish to avoid "silvering" bubbles with the clear film decals,
  • With the other decals applied, the "BE THE BEST" lettering will need to be
    separately cut out and positioned between the other elements of the advert,
  • Final finish mistings of varnish to protect the decals from scratching.
